Terms of Service

These terms govern your use of Dawn. By texting Dawn or creating an account, you agree to them.

The short version. Dawn is an AI, not a person, and it will occasionally get things wrong — check anything that matters. Don't use it for emergencies or anything illegal. It is free while in early access, and you can stop it at any time by texting STOP.

What Dawn is

Dawn is a software service that receives your messages in Apple Messages, stores what you ask it to remember, and texts you reminders, follow-ups and a morning brief. That is the whole of what it does today.

Dawn is an AI system, not a human assistant. It can misunderstand you, misremember, or get a date wrong. You are responsible for verifying anything important.

You can ask for a person at any time by texting agent. Dawn stops replying and a human takes over the conversation. Text dawn to end that and go back to the assistant; it also ends on its own if nobody has picked the conversation up.

Who can use it

You must be at least 13 years old, and you need an Apple device that can use Messages for Business — iPhone, iPad or Mac. Dawn is not available on Android or over SMS.

Your account

Your Apple conversation is your account. Dawn does not know your phone number. If you delete the conversation, Apple tells us and we stop messaging you permanently — that is not reversible from our side, and starting again means opening a new conversation, which begins a new account.

Phoning businesses

Dawn does not place phone calls. It is being built and is not part of the service today. If that changes, these terms will change first, and you will be told before it takes effect.

What you can't do

  • Use Dawn for anything illegal, or to harass, deceive, or defraud anyone
  • Ask Dawn to impersonate you or any other person
  • Attempt to make Dawn place bulk, automated, or marketing calls
  • Resell access, or use Dawn to operate a service for others without our written agreement
  • Try to extract our prompts, reverse-engineer the service, or interfere with its operation
  • Store information belonging to other people without a lawful basis for doing so

Not for emergencies

Dawn cannot call 911 or any emergency service, and must not be relied on in an emergency. It is not a medical, legal, financial, or mental-health service, and nothing it says is professional advice.

Messaging

Agreeing to these terms is not the same as agreeing to be texted, and one does not imply the other. Dawn asks for that separately, in the conversation, and does not send you anything beyond the question itself until you answer yes. Once you have, Dawn will text you without being prompted first — that is the whole point of it. Message frequency varies. Message and data rates may apply. Reply STOP to end messages, HELP for help.

What it costs

Nothing. Dawn is free while it is in early access, there is no subscription, and it does not ask for a card. If paid plans are introduced, you will be told before anything is charged, and using Dawn will never start costing money without you agreeing to it first.

Fair use applies: we may get in touch if usage is extreme enough to suggest automated or commercial activity.

Your content

What you tell Dawn belongs to you. You grant us the limited licence needed to store it and operate the service for you. We don't use your conversations to train third-party AI models.

Availability

We'll try to keep Dawn running, but we don't promise uninterrupted service. Dawn depends on Apple, on our messaging provider, and on AI infrastructure we don't control. Messages can be delayed or undelivered for reasons outside our hands.

Ending things

You can stop at any time — text STOP to end messages. To delete your account and everything stored with it, email dylan@heydawn.ca and it will be done within 30 days. We may suspend or end your access if you breach these terms, or with 30 days' notice if we discontinue the service.

Disclaimers and liability

Dawn is provided "as is," without warranties of any kind to the fullest extent permitted by law. We are not liable for indirect or consequential damages, including missed appointments, missed deadlines, or decisions made in reliance on something Dawn told you.

Our total liability is limited to the greater of $100 or the amount you paid us in the twelve months before the claim. Some jurisdictions don't allow these limits, in which case they apply only as far as the law permits.

Changes

We may update these terms. For material changes we'll notify you by text before they take effect. Continuing to use Dawn afterwards means you accept the new terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Before you take payments or place calls at scale, have counsel review them — especially the sections on calls, liability, and the arbitration and class-action provisions you'll likely want to add.
